About Andra Saunders

I have over 20 years experience working in the field of employment rights, becoming a solicitor in 1994. I am passionate about individuals having access to justice and have chosen to act only for employees/workers. I have a particular interest in constructive dismissal, breach of contract, disability/sex discrimination, redundancy/unfair dismissal, employee status and pregnancy and maternity rights, with a genuine enthusiasm for what I do.

I also have considerable experience of advising on settlement agreements and an understanding that clients usually require a swift resolution in order to achieve closure and move on with their lives.

I fully recognise that each client’s employment situation is unique and I am committed to ensuring that the balance of power between an employer and employee is redressed with regard to any potential conflict within the workplace. My extensive experience of conducting claims in the Employment Tribunal has honed my advocacy skills and I obtain successful outcomes for my clients. I have brought claims in the Employment Appeal Tribunal and County Court.

I have advised and represented a wide range of clients University Lecturers, Senior Managers, Lawyers and individuals within the television and entertainment sector, to name but a few.

I have run a number of complex and high profile discrimination cases. One such notable case involved a gay client who suffered from bipolar disorder being accused of sexually harassing a male colleague in a BBC news room. My client was successful in a claim before the Employment Tribunal of disability discrimination against the BBC. This case obtained national news coverage.

I am familiar with high value negotiations and I have acted on behalf of claimants in multi-party actions against their employers, most recently acting on behalf of a group of 25 claimants.

Client care is my top priority and minimising the stress involved in a case as much as possible for clients. I am tenacious, conscientious and dedicated to achieving a successful resolution for my clients without the need for protracted litigation but if necessary will leave no stone unturned to achieve the required outcome for my client.

I have regularly presented training courses on all aspects of employment law matters.


Notable cases/Key achievements

Pannu & others v Geo W King Ltd (in liquidation) [2012] IRLR 193 – the Employment Appeal Tribunal considered the interaction between regulations 3(1)(b) and 3(3)(b) of the Transfer of Undertakings (Protection of Employment) Regulations 2006 in ascertaining whether there had been a service provision change. My clients argued that the activity that they were carrying out when their employer (the First Respondent) went into liquidation constituted a service provision change and as such they had transferred to either the Second or Third Respondent. This case was the first Appellate decision on regulation 3(3)(b) TUPE 2006 which provides that there is no TUPE transfer when the activities consist wholly or mainly of the supply of goods. Embassy of Brazil v De Castro Cerqueira – [2014] 1 WLR 3718 [2014] ICR 703 – The Employment Appeal Tribunal found that an Employment Tribunal was correct to find that a claim made by my client, a Brazilian Embassy employee in London for unfair dismissal/age discrimination had been validly served under the State Immunity Act 1978 s12 by being sent via the Foreign and Commonwealth Office to the Ministry of Foreign Affairs in Brasilia.
